Subject: Meaningful intellectual property rights for the audiovisual sector in the Digital Services Act

The audiovisual value chain has been made more fragile by the interruptions to business brought by COVID-19. With this in mind, it is vital to ensure that the intellectual property rights of Europe’s film and audiovisual sector are upheld online, and to enact a regulatory environment that promotes investment and recoupment. The film and audiovisual sector is sustaining severe losses from the widespread illegal use of copyrighted content, including during the pandemic. The proposed Digital Services Act represents a new opportunity to reaffirm Europe’s ambition of protecting intellectual property.

1. Does the Commission agree that the Digital Services Act should not in any way result in broader ‘safe harbour’ and liability privileges?

2. Does it recognise that expanding the ‘Know your business customer’ obligation to the full range of services that enable operating an information society service offers a real and tangible solution to reduce illegal content with minimal burdens on intermediaries and legitimate businesses?
