Subject: Air pollution control

Directive (EU) 2016/2284 (the National Emission Ceilings (NEC) Directive) on the reduction of national emissions of certain atmospheric pollutants is the main legislative instrument available to Member States to meet the targets set in the clean air programme for 2030. It also set clear emission-reduction targets for the period 2020-2029 and makes it compulsory to carry out a transparent analysis of the effectiveness of the measures taken by Member States to achieve those targets.

In the Commission’s report on the progress made in the implementation of the NEC Directive, the Portuguese Government’s lack of commitment to complying with the Directive is clear. In this connection:

1. Has the Commission pointed out to the Portuguese Government that the mandatory public consultation was not carried out in the preparation of the Portuguese national air pollution control programme (NAPCP)? If so, what justification was given?

Given Portugal’s medium and high levels of non-compliance with its emission reduction commitments, for both 2020-2029 and 2030 and beyond, and the Portuguese Government’s failure to present additional measures in its NAPCP:

1. What justification did the Portuguese Government give for the above?

2. Does the Commission have a strategy to ensure that Portugal makes good on the commitments agreed?
